Shine on intimates offers its customers the opportunity to purchase the products from its webshop www.shineoninitmates.com. These general terms and conditions apply to every order that is placed. The contract that binds the parties consists of every distance contract concluded between Shine on intimates and the consumer. The general terms and conditions are communicated to each agreement. By placing an order through www.shineonintimates.com, the customer accepts these general terms and conditions without reservation and waives any of his own general terms and conditions, even if they state that they are the only ones that apply. Invalidity of any provision of the general terms and conditions does not invalidate the agreement in its entirety. Only the invalid provision should be banned.
The products displayed on www.shineonintimates.com are presented with the utmost care. The photographs and information shown on the website are as accurate as possible. However, these give an approximate representation of the substantial features of our products. The purchaser accepts that, upon delivery, certain non-substantial characteristics of a product may differ from the photographs and descriptions displayed on the website. Obvious errors or mistakes in the offer are not binding to Shine on intimates. If an offer has only a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer. The buyer places his/her order on www.shineonintimates.com, using the specified procedure. Automatic registration systems are deemed as evidencing the order type, content and date. The sale will only go through once Shine on intimates has confirmed the order.
As the ground materials Shine on intimates uses are very exclusive, Shine on intimates reserves the possibility of not confirming an order when a certain material is no longer available or for any reason whatsoever.
Prices are expressed in Euro, including VAT and are only valid on the date of order. Shine on intimates has the right to modify article prices at any time. Only the price displayed on www.shineonintimates.com is authoritative between the parties. The price is stated exclusively on the items as described literal. The accompanying photos are decorative and may include elements that are not included in the price. The displayed price does not include delivery costs.
All orders are processed when finished, or on the next working day day at the latest. Articles are delivered in Belgium by Bpost within 30 days after confirmation; the specified delivery deadline is for information purposes only. However, the purchaser understands that this delivery period is purely indicative and that we cannot give any guarantees in this respect. Possible delays do not open rights to compensation.
Articles that are delivered outside of Belgium will have a longer transport deadline. For international deliveries, additional taxes and/or costs may have to be paid by the buyer when picking-up his/her article. Articles are delivered to the address specified by the customer when placing his/her order. The buyer will check goods’ packaging at delivery and inform the carrier of possible damages, expressed by handwritten reserves on the delivery slip followed by the buyer’s signature. Shine on intimates does not take responsibility for late deliveries by third parties or for orders which are lost by third parties. However, if an order that has been sent remains undelivered, Shine on intimates will conduct an investigation at the carrier’s end. During this period, Shine on intimates can not provida any reimbursement or proceed to a re-delivery of the products.
The risk of damage and / or loss of products remains with Shine on intimates until the moment of delivery to the consumer or a pre-designated representative made known to Shine on intimates, unless expressly agreed otherwise. The buyer is responsible to make the delivery possible at the indicated address, either by being present himself or by designating a third-party present at the indicated address at the moment of the delivery. A delivery is performed as soon as the ordered products are offered one time at the indicated address. If a delivery is unsuccessful due to a failure by the customer or by the third party designated by the purchaser, the cost of this delivery attempt is fully borne by the purchaser.
Retention of title
The delivered items remain the exclusive property of Shine on intimates until full payment has been made by the customer. Accordingly, it is not possible that third parties could in any way seize articles which have not yet been fully paid for.
Shine on intimates works according to a made-to-order method that uses very exclusive materials. Therefore we ask our customers to first consult all information on an article prior to purchasing it, so the customer is sure that the article fully complies with his/her request. The customer has the right to withdrawal. This only applies to customers who, in their capacity as consumers (and not traders) purchase articles online from Shine on intimates. The customer has the right to withdraw from the sales contract within 14 calendar days without giving reasons. Shine on intimates may ask the consumer about the reason for the withdrawal, but not oblige him to state his reason. We kindly ask you to give us feedback, so we can improve our services in the future. The withdrawal period expires 14 calendar days after the day on which the customer or a third party designated by the customer, who is not the carrier, physically takes possession of the product. The term of 14 calendar days does not apply when it is clearly shown that the product is damaged as a result of transportation. In such event, the customer shall return the product without delay and at the latest within the 3 calendar days.
To exercise the right of withdrawal, the customer must contact Shine on intimates, with address at Stapelplein 42/301, 9000 Gent, telephone +32472381083, e-mail email@example.com via an unambiguous statement, notify his decision to withdraw from the contract. The customer can also use the model withdrawal form in accordance with Appendix 2 Book VI and XIV Economic Law Code. To meet the withdrawal period, the customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired. The customer must return the goods immediately, but in any case no later than 14 calendar days after the day on which he has notified Shine on intimates of his decision to withdraw from the agreement. The customer is on time if he returns the goods before the period of 14 calendar days has expired. The direct costs of returning the goods are fully borne by the customer.
Shine on intimates authorizes the customer to remove the delivered products from their packaging in order to verify that they meet the customer’s expectations. However, Shine on intimates does not accept that products showing clear signs of use (including, but not limited to: stains, streaks, tears, odors, etc.) are returned by the consumer. Also, Shine on intimates does not refund goods manufactured according to the customer’s specifications, or which are clearly intended for a specific person.
Once Shine on intimates receives the returned item, it will be inspect and notify you that we have received it. The customer will immediately be notified on the status of the refund after inspecting the item. If the return is approved, Shine on intimates will initiate a refund to the consumer’s credit card (or original method of payment). The consumer will receive the credit within a certain amount of days, depending on your cards issuer’s policies. If the item did not return or was not approved, Shine on intimates will not refund it. Shipping costs are non-refundable and the customer is responsible for paying the shipping costs for the returning item. If the consumer receives a refund, the cost of return shipping will be deducted from the refund. If you have any questions on how to return your item, please don’t hesitate to contact us.
Pursuant to the law of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights. To make a claim under the warranty, the customer must be able to present proof of purchase. customers are advised to keep the original packaging of the goods. If a defect is found, the customer must inform Shine on intimates as soon as possible. In any case, any defect must be reported by the customer within a period of 2 months after it has been established. Aterwards any right to repair or replacement expires. The legal warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. Problems that manifest themselves after a period of 6 months following the date of purchase, if applicable, delivery, are deemed not to be hidden defects, unless proof to the contrary by the customer.

The customer is hereby informed that the liability of Shine on intimates is in all cases limited to the order amount, regardless of the type of disadvantage. In the event of non-performance, the liability of Shine on intimates cannot be asserted if such failure or improper performance of the sales agreement is due to the buyer or to an unpredictable and insurmountable action by a third party not party to the sale, or a case of force majeure.
Evidence - Applicable Law Disputes
The customer accepts that electronic communications and backups can serve as evidence. All disputes arising from this agreement will be handled exclusively according to Belgian law. Only the courts of East Flanders, Ghent department, are competent to hear disputes arising from the agreement.
